TERMS AND CONDITIONS

Covid-19 Policy

In the event of a regional lockdown by the WA Government preventing you from accessing the property prior to your booking, you can rebook a date within the next 12 months.  Any amount paid to date will be applied to the new booking.

Guest’s Obligations in Respect of the Property

The Guest shall be responsible for the Property during the Guest’s stay.  The Guest shall take all reasonable care of the Property and at the end of the stay shall leave the Property including all utensils, fixtures, fittings and equipment on, in or about the Property in a clean and tidy condition.  The Guest shall be liable for any extra cleaning breakages or damage caused to the Property or any part thereof or any of the chattels therein that may occur during the Guest’s occupation of the Property and all costs for extra cleaning, repair and replacement thereof shall be payable to the Owner from the Guest Bond. Any such costs over and above the amount taken as a Guest Bond may be sought by the Owner through the Local Court.  Any damage or breakage to any part of the Property or any of the chattels therein shall be reported to the Owner as soon as practicable after the damage occurring thereto.

Additional Features (If Any)

If additional features such as a swimming pool, vehicles, boats or other facilities are indicated as being available at the Property concerned at an additional cost to the Guest, the additional charges (if any) will be paid at the time of use unless otherwise stated in the confirmation.  The Guest acknowledges that the use of any additional amenities is entirely at the Guest’s risk and the Owner accepts no responsibility for any injury, loss or damage to property or any third party arising from the use thereof.

Guest’s Property

All personal belongings, baggage, vehicles and other property of the Guest of any description shall be the risk of the Guest at all times and the Owner accepts no responsibility for any loss or damage thereto.

Guest Numbers and Functions

The Guest may only allow the Property to be occupied by the number of persons nominated in the Guest’s application and under no circumstances shall the number of people occupying the Property be greater than that appearing on the Guest’s application or the booking confirmation whichever is the lesser.

The Owner reserves the right to refuse occupation of the Property to the Guest if the condition on the number of people intended to occupy the Property is not observed.  City regulations allow holiday homes to be rented for accommodation purposes only.

Any Functions and gatherings not made aware to the Property managers are not permitted and if evidenced, may be closed down immediately, and the guests will be asked to vacate. Local residents are within their rights to contact the City or the Police should guest activities become excessively disruptive. Any costs (eg: fines) associated with a breach will be the responsibility of guest.

 Requirements for all Functions

  • Under no circumstance do we host large events, weddings or parties at the properties.

  • The Property Manager MUST be informed of any proposed Function, Attendance Number and Hours.

  • The maximum number of guests shall not exceed 18 people at The Grand Eagle Bay and 18 people at Inspiration on Wedgetail

  • City of Busselton regulations stipulate that vehicles are not to be parked on the street/verge. All attendees must park inside the property boundaries.

  • All furniture needs to be returned to original position – additional charges will be incurred should furniture require putting back in original position

  • External noise must cease by 10pm (Noise Levels)

  • Our properties are not Function Centres, they are residential dwellings.

  • No DJs or bands (high-powered speaker systems) will be used.

  • I, the Guest, understand that Eagle Bay Residences or staff cannot be held responsible for any failings of the house that may occur due to hosting an event.

Noise Levels

Any activity at the property shall at all times comply with assigned noise levels within the Environmental Protection (Noise) Regulations 1997. Specifically, music and excessive noise must be restricted from 2200 hours to 0700 hours Monday to Saturday and between 2200 hours and 0900 hours Sundays and Public holidays. Any breach of these restrictions will result in guests being asked to vacate. Local residents are within their rights to contact the City or the Police should guest activities become excessively disruptive. Any costs (eg: fines) associated with a breach will be the responsibility of guest.

  • Eagle Bay Residences MUST be informed prior to booking if you are planning to host a Function or Event, with a proposed attendance number.

  • The maximum number of guests shall not exceed 18 people at The Grand Eagle Bay and 18 people at Inspiration on Wedgetail

  • City of Busselton regulations stipulate that vehicles are not to be parked on the street/verge. All attendees must park inside the property boundaries.

  • External noise must cease entirely by 10pm (Noise Levels)

  • Our properties are not Function Centres, they are residential dwellings. We do not host large events. 

  • We have neighbours who live in Eagle Bay full time. 

  • No DJs or bands or externally provided high-powered speaker systems will be used at any time.

Should we recieve any noise complaints in breach of the above terms then your entire $3000 bond will be foregone

 

Right to Refuse or Revoke Bookings

The Owner reserves the right to revoke or refuse to honour any property accommodation booking which may in their opinion (and at their sole discretion) be unsuitable for the Property concerned.

‘Leavers’ bookings are not accepted. If a booking is found to be made by or on behalf of a Leavers group it will be immediately cancelled and no refund of the deposit will be considered.

Cleaning

Your cleaning fee will be take out of your bond once the property has been assessed.

Generally we recommend to budget for around $1000 - $1300 to be charged which includes cleaning and linen.

  • To avoid additional charges the following must be completed before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, bins put out and crockery and cutlery washed and packed away.

  • Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc.

  • A linen fee of up to $200 will be charged for damaged or heavily soiled linen.

  • All furniture and furnishings must be left in the position they were in when you arrived.

  • Animals and Pets

  • Animals are generally not accepted on the properties. Should animals be found on the premises without strict prior approval the FULL BOND amount will be foregone.

WIFI

Due to the location of the property we have been unable to secure an internet port. We do use mobile broadband at the property but due to the unreliability we do not guarantee there is working wi-fi at the property.

Booking Confirmation

Once a Guest’s booking has been confirmed, the Guest shall be responsible for payment of the total price for the rental period and all extras (if any) as shown on the confirmation notice on or before the date or dates referred to in such notice.

Please note if you book online and book below our minimum stays listed on the website we hold the right not to accept your booking, the minimum stay is as follows:

Seasons:

  • Low Season – 2nd May till 14 September

  • Mid Season – 15th September till 14th December

  • Peak Season – 15th December till 31st January

  • Mid Season  – 1st February till 1st May

Minimum stays:

  • Peak Season 7 nights

  • Mid Season – 4 nights

  • Low Season – 3 nights

Payment

A deposit of $3000 is to be paid in order to secure a booking. The remaining accommodation and bond is required for payment 4 weeks prior to check in.

Bond

Upon check out we will refund the bond deducting your cleaning and any damages. For noise complaints we will not return your bond. Remaining bond is returned 21 Days after check out should everything be ok.

We reserve the right to increase the bond should we feel necessary. Some causes of increased bonds may be high guest numbers, events, functions or gatherings.

Representations

The Guest acknowledges that the Owner has used its best endeavours to describe the Property to the Guest within the limited extent of the communications between the Guest and the Owner and the Owner shall not be liable to the Guest in any respect should the Guest consider the Property to be unsuitable for any reason whatsoever. Whilst we are continually working on maintenance issues, we cannot guarantee that all issues will be resolved before each stay.

Description of the Property

All information in respect of the Property contained in the Owners brochure is believed to be correct at the time of printing, however all details contained in the brochure are subject to change by the Owner without notice.  The Owner will not accept any responsibility for any alterations to the Property or any part thereof beyond the Owners control or any liability for any matter or occurrences beyond the Owners reasonable control including damage caused by extreme weather conditions, break down of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

Availability of Property

The short term accommodation contract negotiated by the Owner and made between the Guest and the Owner is made on the understanding that the Property and its facilities as stated in the booking confirmation will be available as represented to the Guest.  Should any events whatsoever arise beyond the reasonable control of the Owner which render the Property uninhabitable (for example flood, fire, storm, tempest, etc) then the Owner may have to cancel the Guest’s booking for the Property.  The Owner will refund all monies paid by the Guest in respect of the Property.  Upon refund of the monies paid, the guest shall have no further claims whatsoever against the Owner of the Property.

Cancellation Policy

Once your booking has been confirmed and receipted your deposit is non-refundable.  If the booking is cancelled in writing more than six weeks from the date of commencement of your holiday you will be released from the liability for the full balance of hire.  The deposit is non-refundable.

If written notice of cancellation is received less than six weeks prior to the date of commencement of your holiday and we are successful in finding guests to fill your place at the Property you will be released from the liability for the full balance of hire.  The deposit will not be refunded.

We recommend that the Guest takes out comprehensive holiday cancellation and protection insurance with a reputable insurance company to cater for any unforeseen circumstances which may arise including accident, ill health or any other matters beyond the Guest’s reasonable control, as once the booking has been made and confirmed, the Guest will be responsible for payment of the full rental whether or not occupation of the Property occurs

Rental Contract

The rental contact is between the Guest and the Owner of the Property for which the accommodation booking is made and is subject to the terms and conditions herein.  The contract for accommodation shall not be effective until the Guest receives written confirmation of the booking.

 

Deposit

The accommodation booking will not be confirmed until the Guest’s $3000 deposit payment is received and cleared. If the accommodation booking is made within four (4) weeks of the date of commencement of the Guest’s proposed holiday, the full rental payable for the Property is required together with any bond, credit card information and any other payment applicable.

Final Payment

The full amount payable in respect of the Property rental shall be paid at least four (4) weeks prior to the date of commencement of the booking.  If the full payment has not been received by the Booking Agent at least Twenty-eight (28) days prior to the start of the rental period, then the Owner reserves the right to cancel the booking without notice and the Guest will forfeit the Guest’s deposit which will be non-refundable in such circumstances.

Check in procedure

  • Two sets of keys will be placed in a secure coded key

  • The combination will be supplied along with the alarm security code before your arrival.

Acknowledgment of Eagle Bay Residences Terms and Conditions

By selecting yes to “I have read, understand and agree to the Eagle Bay Residences Terms and Conditions (Accessible via the link in the footer at the bottom of our website)” on the booking form, you agree to comply with the terms and conditions of the owner.

Agreeing to pay the total cost of any incidents, damage or call out fees that yourself or your guests cause.

You also accept that no warning is required to issue an order to be evicted if these above requirements are not met and followed.
